PRODUCT DESCRIPTIONS & RISK OF LOSS

INCLUDES SERVICES AND ITEMS PURCHASED DIRECTLY FROM Gardne (DOES NOT INCLUDE ITEMS MENUED BY THIRD PARTY MERCHANTS):

All Services and items purchased from Gardne are made according to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. If an item purchased through our site was not received, meaning you have reported it not received, and there was no proof of delivery, we will at our discretion send another item or refund you the purchase price. While we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability concerning the Website and the App or the information, products, services, or related graphics contained on the App for any purpose. Any reliance you place on such information is therefore strictly at your own risk. Please note that Gardne, website and our App and the information rendered is highly dependent on many outside factors including but limited to, the availability of cellular service, the availability of an internet connection and their respective signal strengths. Our program includes the additional utilization of the compass built or used by your mobile device, and highly relies on GPS signal. Thus, any inaccuracies or unavailability of any of the above could result in the error in the output and may affect the reliability of the direction, distance, location, and positioning of users, destinations, Gardne, and mobile devices. Please use it at your own risk. You agree not to hold Gardne or any of its associates, affiliates, or any of its direct or indirect partners harmless from any liability of any kind. If you do not agree to these terms, please do not use Gardne and return it unused for a full refund. In no event will we be liable for any loss or damage INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES., or any loss or damage whatsoever arising reliance on the use of Gardne, the website, and/or the app or its accuracy. You agree that our maximum liability, in any case, is limited to the price paid to Gardne for the unit purchased from Gardne.

ITEMS POSTED FOR SALE BY THIRD PARTY MERCHANTS INCLUDING FLASH DEALS AND COUPONS:

  • Time restriction: Every item is valid for the specified timeslot on the day that it is posted. The only way to order the item is to order in available hours. Once the order is placed, it must be picked up before the time is expired.
  • Buyer Use Limits: You can place one merchant at a given time.
  • Other Promotions: May not be used in combination with any other coupons or promotions.
  • Stock Limitations: Quantities are limited to inventory at hand from any given merchant.
  • Value: Cash value.
  • Additional Fees:No additional fees or costs. On order, only delivery charges will be applicable if any Gardne has set those charges. Any additional items or services are not associated with the order that needs to be paid separately. When using a Credit Card a specific services charges will be added to order. Taxes: Sales tax is not included in the orders price. Merchant is solely responsible to purchasers for the items that are advertised.

However, Gardne takes no responsibility for, and will not be liable for, the Service being temporarily unavailable due to technical issues beyond our control. APPLICABLE LAW

By visiting Gardne, you agree that the laws of the State of California, USA, without regard to principles of conflict of laws, will govern these Conditions of Use and disputes of any sort that might arise between you and Gardne or its associates.

DISPUTES

Any dispute relating in any way to your visit to Gardne or to products you purchase through Gardne shall be submitted to confidential arbitration in the County of Santa Clara, State of California, USA, except that, to the extent you have in any manner violated or threatened to violate Gardne intellectual property rights, Gardne may seek injunctive or other appropriate relief in any state or federal court in the State of California, USA, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

We take the privacy of our members VERY seriously!

For our consumers: You will need to provide an email address, first name (or user name) for verification to effectively authenticate your identity to begin using our app. We also ask for an optional profile photo, which could be any photo of your choosing. We also may rely on a third party sign up, which will provide us with your email, user name, and profile photo.

Gardne is committed to ensuring that your privacy is protected. Should we ask you to provide certain information by which you can be identified when using this website or the app, you can be assured that it will only be used in accordance with this privacy statement. Gardne may change this policy by updating this page. You should check this page periodically to ensure that you are informed and with any changes which may concern you. WHAT WE COLLECT:

To provide you with the ability to locate nearby Gardne and homegrown items, we would need to collect the coordinates for your devices for receiving navigation directions or relative distance to Gardne, or when you elect to receive relevant data or Items from a Gardne close by you.

End Users and Consumers:

User name or first name.

WHAT WE DO WITH THE INFORMATION WE GATHER:

In addition to providing the ability for you to choose nearby homemade food, we require this information to understand your needs, and provide you with a better service for the following reasons in particular:

  • We may use the information to improve our products and services.
  • We may periodically send promotional push notifications about our new products or our affiliates, special Items (food grown in Garden), or other information which you may find interesting.
  • From time to time, we may also use your information to contact you for market research purposes or customer service follow-ups.
  • We may use the information to customize the website and the app according to your interests.

We are committed to ensuring that your information is secure. To prevent unauthorized access or disclosure, we have put in place suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect online.

CONTROLLING YOUR PERSONAL INFORMATION:

General Rules and Expectation
Zero tolerance policy

Gardne will not tolerate any abuse of any kind to its policy or its Seller and Buyer. Every reported abuse will be taken seriously and upon validation, the abuser will be banned from using the service. We allow the community to monitor itself and provide the tools to keep any violators permanently outside the community

Satisfaction guaranteed

Every Buyer and every Seller will have the opportunity to meet the expectations of each other. If you choose to be part of the community you will need to agree that if you are a Seller, any Buyer that found your Hosting experience or quality of dining unsatisfactory, you will refund or not charge said guests for their dining experience. If you are the Buyer, and the host feels that your visit was not to the standards of the Host's house rules, then you will have to pay for the experience even if you choose to leave before eating. The rating system as well as feedback is required by all buyers and sellers to ensure a true reflection of the experience. You will be asked to leave feedback before booking another dining experience. As a Seller, you will be asked to leave feedback before you schedule another dining event.

Insurance and safety

Safety is our main concern with every transaction. You will need to exercise caution and must take steps to ensure that you are safe in all situations. For our Buyer, we recommend you read the reviews and make sure the Seller had family or friends attest to their quality and experience of Gardne. For Seller, you will need to approve a Guest before they come to pick up at you Gardne. The exact location of your home Gardne will not be revealed to Guests unless you approve them. We verify every Guest's identity before using the service using third party documented verification.

Limit of liability

Using our service constitute that you fully agree to all the terms and conditions, and the privacy policy of Gardne

Platform not permitted where prohibited

Gardne is available globally through the internet. Thus, we have no control over where it is used and who uses the service. It is your responsibility not to use the service if it is in any way illegal or unauthorized to be used in your area or against any laws in your location.

Getting Started
Pick up or Delivering

The seller has two options to make money. You can select either option or both after you list your item: 1. Post item for buyers. You will be able to accept orders from the buyer. 2. Pack and transfer items to the buyer.

How to sign up as a Seller

You need to select Sign up, enter your information. After successful login, you can create your Gardne.

Initial Offerings

To be able to offer your items to the public and take orders for your Gardne, you will need first to offer items privately. You must invite several of your friends or family members through Gardne to order your items and rate your Gardne. A good rating attracts more buyers and increases your sale.

How to let your friends and family know

It is easy to invite your friends and family to experience your dishes through the App or the website. Simply list your Items and choose to INVITE FRIENDS. Select who you want to be notified. Once they accept, Gardne will send them the needed information to show up as your buyers.

How to price your merchandise

Merchandise sold is usually priced per person. However, orders to be delivered will require a delivery surcharge. It would be highly recommended that you set reasonable delivery fees for your buyers as well as reasonable fees for your items.

How do you get paid?

Once a buyer places an order for pick up or delivery, we will collect the money and hold it until you deliver the Item, or when the item is picked up. We will then transfer the amount collected, less our fee of 10%, to your account with Gardne.

When your account reaches $50, we will send it to you using any of your preferred services such as Paypal, Venmo, or Transfer. Currently we only provide the Paypal support.

What is our satisfaction guarantee and how it affects you

You agree that the buyer must be satisfied with the quality of service you provide. If they report an unsatisfactory rating, you agree to have us refund their money. Any buyer that reports unsatisfactory experience will have that on their rating and feedback profile. You must review every buyer's profile to detect if there is a pattern of this behavior before you approve the buyer.

Equally, if you are unsatisfied with the buyer, and if you feel the buyer is not complying with the rules of the transaction, you will still get paid if you choose to. This will also reflect on both of your profiles and feedback.

Rate your buyer too

Make sure to rate every buyer that orders from you. It is simple to do. After every transaction, you will receive a request to rate the buyer the next day. Simply choose the rating and if you wish you can leave feedback as well.

Getting Started
How to sign up as a Buyer and required documents

Simply sign up and provide a payment method for verification of identity and address. We may require a legal document such as a driver's license or passport to authenticate you. This is for the safety and integrity of our community. You would need to be authenticated and verified before you can place an order from a Merchant. Simply follow the instructions on our App and/or Website. Also, you may set your preferences as to the type of dishes and dining experience you prefer.

How to place an order for merchandise

Once you find the merchandise you wish to purchase, simply place an order for the item and the quantity of it. The merchant will review your request and once approved, you will be sent instructions on where to go. Payment will be charged for the purchased items upon the Merchant's approval.

Once approved what's next?

You will get directed to the exact location where you will pick up your purchased items and complete the transaction. Thank the Merchant and we hope to see you again.

How to order merchandise to be delivered or picked up?

Simply browse products available for sale for delivery or pick up. Make sure you are not selecting the “pick up” option if you want your order to be delivered.

How paying for your experience works?

Once you place an order for merchandise, we will hold your payment authorization (not collected) until the Merchant approves your request. This would take 24 hours or less. Once approved, you will be charged the amount owed. This is nonrefundable upon Merchant’s approval. Then you will be sent directions for where to go.

Satisfaction guaranteed

Merchants agree that if you are unsatisfied with the quality of their items, then they would offer you a partial or a full refund. However, the rating and feedback will reflect the fact that this event has occurred and will be available publically. Refunds affect both the Customer and Merchant and can play a major role in determining the desire to purchase from this Merchant and the likeliness of a Merchant approving a Customer. Therefore, both the Merchant and the Customer need to ensure the experience is optimal to avoid negative ratings.

How to cancel your order

You can cancel an order any time before having the seller approve it. Once the seller approves your order, you will not be able to cancel or be issued a refund.

Ratings and comments

You will be required to rate your seller the day after your purchase. This is important to ensure the quality of our community. A request will appear on your app to rate the experience. Simply select your rating and if you wish to leave feedback, it would be helpful for other members.
